Terms of Service

1. The Service

partycard.fun is a platform for discovering, playing, and sharing small web games, operated by FunHub Labs LLC (“partycard.fun,” “we,” “our,” or “us”). By creating an account or otherwise using partycard.fun (the “Service”), you agree to these Terms of Service (the “Terms”). Our Privacy Policy explains how we collect and use information when you use the Service and is incorporated into these Terms by reference. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old to use partycard.fun (16 in the European Economic Area). By using the Service you represent that you meet this requirement and that you have the legal capacity to enter into these Terms. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf.

3. Your Account

You are responsible for anything that happens under your account. Keep your login credentials secure, and notify us promptly if you believe your account has been accessed without your permission. You may delete your account at any time from the in-app Settings screen.

4. User-Generated Content

Where game creation, publishing, or remixing features are available, partycard.fun lets you publish, share, and remix games. “User Content” means any content you submit to or make available on the Service, including your display name and profile information, anything you enter while playing a game, feedback you send us, and any games or prompts you create where those features are available. You retain ownership of the User Content you create, but you grant partycard.fun a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, display, distribute, and make derivative works of that content, in any media, for the purpose of operating and promoting the Service. If you publish a game, you also grant each user of the Service a non-exclusive license to view, play, and — where the remix feature is available — remix your game within the Service, including by creating derivative games. These licenses survive termination or deletion of your account or content to the extent the content has been shared with or remixed by others, or as needed for backups and legal compliance.

5. Prohibited Content and Conduct

You agree not to publish, upload, generate, share, or otherwise make available any content that:

• contains hate speech, slurs, or content that promotes violence or discrimination against any group;
• harasses, bullies, threatens, stalks, doxes, or otherwise targets a specific person or group;
• infringes any third-party intellectual property right, including copyrights, trademarks, publicity rights, or trade secrets;
• depicts, simulates, or facilitates real-money gambling, betting, lotteries, or games of chance with prizes;
• is sexually explicit or pornographic, or sexualizes minors in any way;
• is unlawful, promotes illegal activity, or violates any applicable law or regulation;
• contains malware, spyware, viruses, cryptominers, or any code intended to damage, disable, or compromise another user’s device, data, or account;
• impersonates another person, misrepresents your affiliation with any person or entity, or uses the Service to defraud others;
• harvests user data, scrapes the Service, or circumvents any access or rate-limiting controls.

We have zero tolerance for objectionable content and abusive users. You can report any game or user from the Service and we aim to review reports promptly.

6. Moderation and Enforcement

partycard.fun reserves the right, but has no obligation, to review any User Content and to remove, restrict, or refuse to publish any content that we believe, in our sole discretion, violates these Terms or is otherwise objectionable. We may also suspend or terminate any account that violates these Terms, without prior notice and without refund.

Where publishing features are available, published games pass through a moderation step before appearing in the public feed. This moderation may combine automated pre-screening and human review. Moderation decisions are final, though you may contact us if you believe a decision was made in error.

7. AI-Generated Content

Some games on partycard.fun are produced with the help of AI agents. If prompt-based game creation is available to you, you are responsible for the prompts you submit and for the content those prompts produce under your account. partycard.fun does not guarantee that AI-generated output is accurate, safe, or fit for any particular purpose, or that any game or other output is protectable by copyright or other intellectual property rights; similar output may be generated for other users. As between you and partycard.fun, we claim no ownership of the games you create; your rights and license grants are as described in Section 4.

8. Intellectual Property

The partycard.fun name, logo, and underlying software are owned by partycard.fun and are protected by intellectual property law. Nothing in these Terms grants you any right to use partycard.fun trademarks without our prior written permission.

9. Copyright Complaints (DMCA)

We respect intellectual property rights and respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act. If you believe content on the Service infringes your copyright, send a notice containing the elements required by 17 U.S.C. § 512(c)(3) to our designated agent: support@partycard.fun. We may remove or disable access to material alleged to be infringing, notify the user who posted it, and accept counter-notifications as provided by law. We terminate the accounts of repeat infringers in appropriate circumstances.

10. Termination

partycard.fun may remove any content, suspend any account, or terminate any user’s access to the Service at any time and for any reason, including but not limited to violation of these Terms. You may stop using the Service and delete your account at any time from Settings.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, PARTYCARD.FUN DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PARTYCARD.FUN WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. TO THE FULLEST EXTENT PERMITTED BY LAW, PARTYCARD.FUN’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (US$100) OR (B) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain warranty exclusions or liability limitations, so some of the above limitations may not apply to you.

13. Indemnification

You will indemnify, defend, and hold harmless partycard.fun and its officers, members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your User Content or the prompts you submit; (b) your use of the Service; (c) your violation of these Terms; or (d) your violation of any third-party right.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws rules. Any dispute arising from these Terms or the Service will be resolved exclusively in the state or federal courts located in Wilmington, Delaware, and you and partycard.fun consent to their jurisdiction. Before filing a claim, you agree to first contact us and try to resolve the dispute informally; if it is not resolved within 30 days, either party may proceed. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND PARTYCARD.FUN EACH WAIVE THE RIGHT TO A JURY TRIAL AND AGREE THAT ANY DISPUTE WILL BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

15. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

16. General

These Terms are the entire agreement between you and partycard.fun regarding the Service and supersede any prior agreements. If any provision of these Terms is found unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in full effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, reorganization, or sale of assets, or by operation of law. We may modify, suspend, or discontinue all or part of the Service at any time without liability. You are solely responsible for your interactions with other users. Sections 4, 8, 10 through 14, and this section survive any termination.
